LIMITED WARRANTY AND RETURN POLICY

Congratulations on the purchase of your new PopTimer Pro100™! As a catcher, you have just made one of the best decisions
of your career. You now own the most sophisticated and accurate data collection system ever created for catchers. Below you will find the information you may need if you have a technical problem with our product and need to return it. We hope that this never happens as we strive to help every catcher perform at their best with our technology.

You may return the PopTimer Pro100™ for a full refund of the purchase price within 30 days of purchase so long as it is unopened and/or unused and in the same condition as when purchased. In the event your product is damaged or doesn’t work out of the box, please note Caught Stealing LLC’s limited warranty and return policy detailed below.

WHO CAN USE THIS WARRANTY?

We extend this limited warranty only to the customer who originally purchased the product. It does not extend to any subsequent owner or other transferee of the product.

WHAT DOES THE WARRANTY COVER?

This limited warranty covers defects in materials and workmanship of the PopTimer Pro100™ for the Warranty Period as defined below.

WHAT DOES THE WARRANTY NOT COVER?

This limited warranty does not cover any damage due to: normal wear and tear, defects or damage caused by misuse, accident, neglect, abuse, alteration, unusual stress, modification, water damage, improper or unauthorized repair, improper installation, improper charging, improper storage or use in a way not intended of the PopTimer Pro100™, use not in accordance with the documentation, damage caused by the equipment with which the product is used, or other damage caused by external actions beyond our control. Please note that the PopTimer Pro100™ is water resistant to exterior moisture and sweat but not completely waterproof. The system is not intended to be immersed in water, and doing so will invalidate the warranty.

HOW LONG DOES THE WARRANTY LAST?

This limited warranty starts on the date of purchase and lasts for one year (the “Warranty Period”). The Warranty Period is not extended if we repair or replace the product.

WHAT ARE THE REMEDIES UNDER THIS WARRANTY?

Within the first 30 days of the Warranty Period, you may return the defective product for a full refund of the purchase price. At any time during the Warranty Period thereafter, we will, in our sole discretion, either repair or replace the defective product (or the defective part) free of charge. We will also pay for shipping and handling fees to return the repaired or replacement product to you.

LIMITATION OF LIABILITY

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

HOW DO YOU OBTAIN WARRANTY SERVICE?

To obtain warranty service, you must email our customer support team at info@caughtstealing.com within the Warranty Period and no later than three days after determining the product is defective. You must then ship the product back to us using USPS Ground shipping to the address listed below within 15 days. If we determine the product qualifies for warranty service, we will, as appropriate, issue a refund for the full purchase price and the cost of return shipping, or repair or replace the product and pay to ship the repaired or replacement product back to you.
